Chautauqua County mother faces additional charges in child’s death
BUFFALO, N.Y. (WIVB) — A mother from Silver Creek is facing additional charges following the death of her 12-year-old child in April and the alleged neglect of two others, according to the Chautauqua County District Attorney’s Office.
Ashley Bertino, 36, was charged with second-degree murder in November after diabetes was left untreated in her daughter Mya, and she died as a result.
Unsealed indictments revealed Monday that Bertino is also charged with second-degree manslaughter and three counts of endangering the welfare of a child. Bertino’s two other children allegedly did not see doctors in a timely manner and did not always receive proper sustenance.
Officials said Bertino, “did engage in a course of conduct evincing depraved indifference to human life, which created a grave risk of death to another person.”
Bertino received the murder charge at a preliminary hearing in November before the case was sent to a grand jury in December. She appeared in court Monday and will return later this month.
Bail was set at $500,000 property bond or $250,000 cash.
